Introduction

F0rmula!, owner and operator of HappyBridge, is committed to respecting the privacy rights of visitors to and Users of its Site and App. This privacy policy explains how HappyBridge collects, stores and uses personal data about the User when he/she chooses to register as a User and uses the Services. This policy will provide the User with details about the types of personal data that HappyBridge collects, how we use the User’s personal data and the rights the User has to control our use of this data. Words used in this Privacy Policy have the same meaning as is attributed to them in the HappyBridge Terms and Conditions.

Types of Personal Information HappyBridge Collects

When the visitor registers as a User for the Services, the User interacts with the Services or when the User purchases additional services from HappyBridge, we may collect some or all of the following personal data about the User:

  • A name, password and email address;

  • Date of birth, age and sex;

  • Billing and delivery addresses, and phone number(s);

  • The User’s Stories, Images and other User Content;

  • The User’s Stories, Images and other User Content;

  • The User’s preferences about receiving communications from HappyBridge; and

  • Information about your use of HappyBridge including online purchasing activities.

In order to take advantage of some of our Services, you may need to supply us with the personal details of a third party (for example, the name and address of a Relative the User wishes to add to the Services). We will not use this information for anything other than providing the Services for which the information was supplied.

How does HappyBridge use the User’s personal information

The User’s personal data will be collected, processed, stored and used by HappyBridge:

  • To provide HappyBridge to the User;

  • To personalise the User experience;

  • To provide the means to share and view User’s stories between the User, Relatives and other family members.

  • To convince invited family members by the User to start using the Services

  • To send reminders to the User about the Services

  • To associate the User’s Account, and User purchases, with the User, and to verify the User’s identity;

  • To process payments the User makes for additional services;

  • To contact the User

  • For customer satisfaction and improvement purposes; and

  • For the prevention and detection of fraud and other crimes.

HappyBridge may automatically collect anonymous information about the User’s use of HappyBridge. The User cannot be identified from any of this information. It just enables HappyBridge to compile statistics about the use of the Services and help us improve the latter.

Disclosing personal data

HappyBridge will not disclose any of the User’s personal data, other than to payment service providers under contract with us, without the User’s permission unless:

HappyBridge is legally entitled to do so (this could for example be in the case of a pursuant to a court order or for the purposes of prevention or detection of crime or fraud);

HappyBridge would be in negotiations with a third party to be acquired by the latter or is acquired by a third party, in which case personal data held by HappyBridge about its customers will be one of the transferred assets; or

To enforce or apply HappyBridge Terms and Conditions, and other agreements to which the User is party, or to protect HappyBridge’s rights, property, safety, customers, or others.

Communication

The emails and mobile communication that HappyBridge sends to the User can be categorised into two distinct types:

Emails and mobile communication which gives the User information about offers, new Products and other things that the User might find interesting. The User can choose not to receive this form of communication by sending a message to helpdesk from their Account email address with subject “Stop Newsletter”.

Emails and messaging alerts that HappyBridge sends regarding activity on the User’s Account, specifically but not exclusive:

  • To remind the User of approaching submission deadlines;

  • To stimulate the User to submit additional stories;

  • To stimulate the User to invite other family members;

  • To stimulate the User to review the automatically created stories from their social media account;

  • To notify the User that there are new stories in the family feed;

  • To stimulate the User to complete his/her profile or that of a Relative;

  • To explain the User how the additional services procured work;

  • To warn the User that the credits are running low;

  • To encourage the User to recharge credits;

  • To remind the User of free credits that may be in his/her Account;

  • To explain the User how the credit system works;

  • To encourage the User to partake in a surveys about the Services; and

  • To remind the User that he/she has an Account.

The User can choose not to receive this form of communication via email by sending a message to helpdesk from their Account email address with subject “Stop Notifications”.

While HappyBridge does its best to act on the User’s preferences as soon as it reasonably can, please be aware that it may take up to 30 days for changes to the User’s preferences concerning emails, mobile communications and messaging alerts to take effect.

Please be aware that emails regarding purchases the User made, and emails which notify the User of changes to HappyBridge’s Terms and Conditions, Privacy Policy and Product Service Agreements, will always be send to the User regardless of the preferences of the latter regarding emails, mobile communications and messaging alerts.

Access to personal information

The Belgian privacy act of 1992, amended in 1998, which protects and upholds the rights of the personal privacy in terms of processing personal information, gives the User the right to access personal data held about the User. The User’s right of access can be exercised in accordance with this Act. Any access request needs to be dated, signed and send via mail to HappyBridge to the address specified below, where the User will prove his/her identity with a copy of his/her identity card or passport. When these conditions are met, HappyBridge will share in writing all the User’s personal details that are saved. The User has the right to ask to change personal information that is incorrect, incomplete or irrelevant free of charge. In order to exercise this right, the User needs to contact HappyBridge, either via email or mail.

At any time the User can request to view, remove or change his/her personal details. This request can be made via mail or email, and HappyBridge will take appropriate action as soon as possible. The personal information that the user wishes to be removed, will be deleted as soon as possible, with the exception of the information that is required to provide the User with the services that he/she has ordered.

Most of the User’s information can be viewed, updated and removed via the “My profile” screens in the Services.

Links to third parties

This Privacy Policy applies only to HappyBridge. It does not apply to sites that have linked or are redirected to or from HappyBridge, regardless of whether or not such link or redirection is authorized by HappyBridge. Security

HappyBridge takes appropriate technical and organisational measures to guard against unauthorised or unlawful processing of personal information of the User and against accidental loss or destruction of, or damage to, personal information of the User. Although HappyBridge has security measures in place to protect our database and access is restricted internally, it remains the User's responsibility to:

  • Make sure no-one else uses HappyBridge through his/her Account;

  • Logout of HappyBridge when not using it; and

  • Keep the personalised password and any other access information secret.

Note of caution

The Services contain areas where the User can choose to share personal information with Relatives and other family members. The access and use of these areas are subject to the Terms and Conditions of HappyBridge. Any information, including personal information, that the User shares with these individuals, will be readable and collectable by the latter who may further disseminate such information.

Users should never respond to emails or mobile communications that ask to confirm any details of the User Account or payment method. HappyBridge will never ask such information via those channels.

Changes to this Privacy Policy

HappyBridge reserves the right to change this Privacy Policy. Such changes may be announced to the User either by email or by the posting of the revised policy on the Service. The User is responsible for reviewing both his/her email and the Service to determine what is the then-current Privacy Policy.
